Terms and Conditions
Version 1.0, 20 September 2026.
1. Who these terms apply to
- These terms apply to every quote, assignment and agreement between The Content Den, KVK 42122623 (“we”, “us”) and the client (“you”). Any terms of your own that conflict with these do not apply unless we agree to them in writing.
2. Quotes and agreements
- Quotes are valid for 14 days and are non-binding until accepted.
- An agreement is formed once you confirm a quote or package in writing, including by email.
- All prices are in euros and exclude VAT.
3. What we deliver
- The deliverables, quantity and format are described in the quote or package.
- Unless agreed otherwise, we deliver content as digital files, ready for you to publish. Publishing and scheduling are your responsibility.
- Content is created for the channels and purpose agreed in the assignment.
4. Your input
- You provide the information, brand assets and access we need to do the work, on time.
- You are responsible for the accuracy of the information you give us, including any factual, medical, legal or product claims.
- If your input is delayed, delivery dates shift accordingly.
5. Revisions
- Every assignment includes one round of revisions on the delivered content.
- Feedback is given in one collected set, within 7 days of delivery.
- Additional revisions beyond your package are charged at €25 per post.
6. Timelines
- Content is delivered within one week (5 working days) of receiving your brief and all required input, unless agreed otherwise.
- For monthly packages, the batch for the coming period is delivered within one week of the start of each cycle.
- If your input is incomplete or late, the delivery term starts once we have everything we need.
7. Payment
- One-off assignments: 50% on confirmation, the remainder on delivery, unless agreed otherwise.
- Monthly packages: invoiced in advance per month.
- Payment term: 14 days from the invoice date.
- If payment is late, we may pause work and, after a reminder, charge statutory interest and reasonable collection costs.
8. Cancellation and ending the agreement
- Monthly packages can be ended by either party at the end of a calendar month, with one month notice.
- If you cancel a one-off assignment after we have started, we charge for the work completed up to that point.
- We may end an agreement if you repeatedly fail to provide the input needed, or if payment is not made after a reminder.
9. Rights to the content
- Once payment has been made in full, you receive the right to use the delivered content for your own business, for the agreed channels, for an unlimited period.
- Until full payment, we retain all rights to the delivered work.
- We may use the delivered work in our own portfolio and social channels, unless we agree otherwise in writing.
- You may not resell the content as a standalone product to third parties.
10. Visuals, texts and AI-generated material
- Visuals and texts we deliver may be created with the help of AI tools, unless agreed otherwise.
- Where we use third-party stock or tools, we comply with their licence terms and pass the relevant restrictions on to you.
- You are responsible for checking that the content complies with the rules of the platform you publish on, including any disclosure requirements for AI-generated or advertising content.
11. Liability
- We deliver our work to the best of our ability, but we cannot guarantee any specific result, such as reach, followers, engagement or sales.
- Our liability is limited to the amount invoiced for the assignment concerned in the three months before the damage occurred, and in any case to the amount paid out by our insurer, if applicable.
- We are not liable for indirect damage such as lost profit, missed savings or reputational damage.
- These limits do not apply in the case of intent or deliberate recklessness on our part.
12. Force majeure
- If we cannot perform due to circumstances beyond our control, such as illness, outages at suppliers or platform failures, our obligations are suspended for the duration. Neither party owes the other compensation for that period.
13. Confidentiality
- We treat the information you share with us as confidential and do not share it with third parties, except where needed to carry out the assignment or where required by law.
14. Complaints and applicable law
- Tell us about any complaint within 14 days of delivery, so we can solve it together.
- Dutch law applies. Disputes are submitted to the competent court in the district of Noord-Holland.
